The Service constitutes digital content within the meaning of EU Directive (EU) 2019/770.

4. Institutional Access (IP Authentication)

4.1 Provision of Access

Access is granted to Authorized Users when accessing the Service through registered IP ranges of an Institution.

4.2 Obligations of Institutions

Institutions must:

  • Provide accurate IP ranges and keep them updated
  • Implement reasonable safeguards against misuse
  • Inform users of acceptable use

4.3 No Individual Contract with End Users

Unless otherwise specified, access via IP authentication does not create an individual paid subscription contract between the Authorized User and us.


5. Permitted Use

Authorized Users may use the Service solely for:

  • Academic
  • Educational
  • Non-commercial research purposes

Any further use requires prior written consent.


6. Prohibited Use

Users must not:

  • Systematically or automatically download, scrape, or archive content
  • Redistribute content commercially
  • Circumvent access controls
  • Share access outside the Institution

We may block IP ranges or suspend access in case of violations.


7. Intellectual Property Rights

All content is protected under EU copyright law and the German Copyright Act (Urheberrechtsgesetz – UrhG).

Permitted:

  • Limited reproduction for teaching and research (§ 60a–60f UrhG, where applicable)
  • Proper citation with attribution
  • Distribution of downloadable material (e.g. PDF documents provided) within the Institution in research or educational context
  • Commercial use by companies not larger than four people and not older than 18 months or by single users, if these companies or single users are affiliated with the institution ("Student Start-ups")

Not permitted:

  • Mass distribution
  • Commercial reuse apart from those examples explicitly permitted

8. Data Protection (GDPR Compliance)

We process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

  • Injury to life, body, or health
  • Claims under the German Product Liability Act (Produkthaftungsgesetz)

12.2 Limited Liability

In cases of slight negligence (leichte Fahrlässigkeit), we are only liable for breaches of essential contractual obligations (Kardinalpflichten), limited to foreseeable damages.

12.3 No Liability for:

  • External network failures (e.g., university infrastructure)
  • Improper use by users

13. Term and Termination

Access is granted for the duration of the institutional agreement.

We may suspend access if:

  • These Terms are violated
  • There is abuse of IP-based access

14. Consumer Rights

Not applicable, since no individual paid subscriptions are offered alongside institutional access.


15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

If the Institution is a merchant (Kaufmann), the place of jurisdiction shall be [Insert City].

Mandatory consumer protection laws of the user’s country remain unaffected.


16. Severability Clause (Salvatorische Klausel)

If any provision of these Terms is invalid, the remaining provisions shall remain in effect.
